As*sump"sit, n. Etym: [L., he undertook, pret. of L. assumere. See Assume.] (Law) (a) A promise or undertaking, founded on a consideration. This promise may be oral or in writing not under seal. It may be express or implied. (b) An action to recover damages for a breach or nonperformance of a contract or promise, express or implied, oral or in writing not under seal. Contrary to popular belief, coffee beans are not technically beans. They are referred to as such because of their resemblance to legumes. A coffee bean is a seed of the Coffea plant and the source for coffee. It is the pit inside the red or purple fruit, often referred to as a cherry. Just like ordinary cherries, the coffee fruit is also a so-called stone fruit.
